(Press Statement) Regarding filing of false cases including public offence, robbery and theft on protesters

Terai Human Rights Defenders (THRD) Alliance shows its serious concern over the recent acts of filing false charges such as public offence, robbery and theft against a dozen of protesters.  

On December 20, UDMF Sarlahi district coordinator Ashok Yadav was apprehended by the police from a local FM radio station ‘Radio Madhes’ in Malangwa, where he was for an interview. A case of public offence has been filed on Yadav. We found that the District Administration Office (DAO) Sarlahi has released him on bail.

Likewise, police investigations into robbery and theft cases that were charged on seven protesters in Saptari district based on the complaints of police themselves within last week of December 2015 are underway. Three of them – Krishna Kumar Payak, 21, of Bhardaha VDC-1, Manaraj Mandal, 20, of Portaha VDC-8, and Sanjit Kumar Yadav, 25, of Bharaha-8 were arrested on charge of robbery. Riju Jha, 20 of Bharaha-4 was also arrested on charge of theft. Although the cases of robbery have been filed against Sanjiv Mandal, 28, of Madhavapur VDC-4, and Narayan Yadav, 27, of Bharadah-8 and Sundar Mukhita of Bhardaha-4 charged with robbery and theft, they have not been arrested.

Similarly, the DAO of Dhanusha on December 24, 2015 filed cases against Shila Devi, 40, of Janakpur Sub-metropolitan city-4 on charge of vandalism and attacks in Janaki Temple under ancient monument preservation act 2013 (BS). We also found that police arrested Sitaram Mandal, Rahul Kumar Raut and Ritesh Kumar Mandal and charged them with public offence.

The state, on one hand, has used excessive use of force during Madhes protest and demonstrations while, on the other hand, false charges such as public offence, robbery and theft have been filed on some innocent youths and Madhesi leaders with an aim to suppress the movement. This is completely against fundamental rights to peaceful demonstration.

We believe that such acts by the state will only push the movement toward further violence. Hence, we demand police to stop filing false charges on innocent protesters following their arbitrary detention and also refrain from using excessive force. We also urge the protesters to organize the protest programs in a peaceful manner.

(प्रेस विज्ञप्ति) आन्दोलनकारी माथि सार्वजनिक अपराध, डाँका, चोरी जस्ता झुठा मुद्दा लगाएको सम्बन्धमा

तराई मधेशमा नयाँ संविधान २०७२ जारी हुनुभन्दा पहिलादेखि नै संयुक्त लोकतान्त्रिक मधेसी मोर्चा र संघीय समावेशी मधेसी गठबन्धनले निरन्तर आन्दोलन गर्दै आएका छन् । सो आन्दोलन तथा प्रर्दशनको क्रममा केही समय यता आन्दोलनकारीहरुलाई पक्राउ गरी सार्वजनिक अपराध, चोरी, डाँका लगायतको झुठ्ठा मुद्दा लगाएको कार्यप्रति तराई मानवअधिकार रक्षक संजाल (थर्ड एलायन्स)को ध्यानाकर्षण भएको छ ।
प्रहरीले २०७२ पौष ६ गते मलंगवा स्थित रेडियो मधेशमा अन्तर्वार्ता दिइरहेको अवस्थामा मधेसी मोर्चाका सर्लाही जिल्ला संयोजक अशोक यादवलाई पक्राउ गरी सार्वजनिक अपराध मद्दा लगाएको छ । निजलाई जिल्ला प्रशासन कार्यालय, सर्लाहीले धरौटी रिहा गरेको पाइयो ।
यसैगरी पुसको दोश्रो हप्ताभित्र प्रहरी जवानकै उजुरीको आधारमा सप्तरी जिल्लाका ७ जनामाथि चोरी र डाँका मुद्दामा अनुसन्धान गरिरहेको छ । भारदह १ का २१ बर्षीय कृष्ण कुमार पायक, पोर्ताहा ८ का २८ बर्षीय मनराज मण्डल र भारदह ८ का २५ बर्षीय संजित कुमार यादवलाई डाँका मुद्दामा पक्राउ गरेको छ । त्यसैगरी भारदह ४ का २० बर्षीय रिजु झालाई चोरी मुद्दामा पक्राउ गरेको छ भने मधवापुर ४ का २८ बर्षीय संजिव मण्डल र भारदह ८ का २७ बर्षीय नारायण यादवलाई डाँका मुद्दा र भारदह ४ का सुन्दर मुखियालाई चोरी र डाँका मुद्दा लगाएको छ तर उनीहरु पक्राउ परेका छैनन ।
त्यसैगरी जानकी मन्दिरमा तोडफोड तथा ढुँगामुढा गरेको आरोपमा जिल्ला प्रहरी कार्यालय, धनुषाले पुस ९ गते जनकपुर उपमहानगरपालिका ४ की ४० बर्षीय शिला देवीलाई प्राचिन स्मारक संरक्षण ऐन २०१३ अन्तर्गत मुद्दा चलाएको छ भने स्थानीय सीताशरण मण्डल, राहुल कुमार राउत र रितेश कुमार मण्डललाई सार्वजनिक अपराध मुद्दामा पक्राउ गरेको पाइएको छ । यस्तै अन्य जिल्लाहरुमा यस्तै प्रकृतिको मुद्दा लगाइरहेको अनुगमनको क्रममा पाइयो ।
एकातिर मधेश आन्दोलन तथा प्रर्दशनको क्रममा राज्य पक्षले विभिन्न ठाउँमा अत्यधिक बल प्रयोग गरेको स्थलगत अनुगमनबाट पाइएको छ भने अर्कातिर आन्दोलनलाई दवाउने उद्देश्यले कतिपय निर्दाेष युवा तथा नेताहरुलाई सार्वजनिक अपराध, चोरी, डाँका जस्ता मुद्दा लगाएको पाइएको छ ।
यस्तो कार्यले मधेस आन्दोलन झन् हिंसात्मक बन्न सक्ने हाम्रो ठहर रहेको छ । तसर्थ प्रहरीले स्वेच्छाचारी रुपमा पक्राउ गरी झुठ्ठा मुद्दा लगाएको पाइएकोले निर्दोष युवाहरुमाथि झुठ्ठा मुद्दा लगाउने कार्य रोक्न माग गर्दछौं । साथै आन्दोलनकारीहरुलाई समेत संयमित भई शान्तिपुर्ण रुपमा आफना आन्दोलनका कार्यक्रमहरु गर्न आग्रह गर्दछौं ।
